Lead counsel Akoto Ampaw for the 2nd Respondent (President Nana Akuffo Addo) pleaded to the Supreme court to strike out 22 paragraphs of Mr. Robert Joseph Mettle-Nunoo, 3rd witness statement. Mr. Ampaw argued that paragraphs 4, 5, 6, 7, 8, 9, 10, 11, 15, 16, 17, 18, 19, 20, 22, 23, 24, 25, 26, 29, 30, and 31 be struck out on grounds that they are borne out of pleadings.

The entire witness statement is 32 paragraphs, with the acceptance of the five objections, Mr. Mettle-Nunoo’s total witness statemen’s paragraphs are now 27.

The lead counsel for the petitioner Tsatsu Tsikata stood on his feet for about three (3) hours and prayed to the court not to strike out those paragraphs particularly paragraph 5 since Rojo Mettle-Nunoo is willing to put his credibility on the line so that if anybody wants to have recourse to the video they are entitled to.

However after break and seating resumed, the court in its wisdom struck out 5 paragraphs, out of the 23 objected paragraphs of the third witness, namely 4, 5, 6, 7 and 18.
