Martin Amidu
I congratulate Mr. Martin Amidu on his appointment as the first Special Prosecutor (SP) though he believes the office of the SP is not constitutional per his initial comments prior to parliamentary decision on the bill.
As John Manama (JM) rightly said in Techiman, there is nothing special about the office of the SP because at the end it is the attorney general who decides which case should go to court and which the government is not interested in. It is indeed a duplication of offices of the Attorney General.
So there is nothing independent about the office of the SP.
Yes, Alamisi Amidu is a bitter man since the days of his removal as attorney General and I believe he is happy for a come back to revenge on those he claim mastered his removal.
Nana Addo saw the bitterness in him and want to use him to execute his agenda. That’s using a bitter NDC member to go after their own.
In this regard Nana Addo wouldn’t be blamed for witch hunting and he will as well satisfy his new found love with former president Rawlings.
But let’s not forget that he tried Woyome and succeeded not.
Let’s not forget now it’s no more about talks but action.
Let’s not forget Agyarko did plenty talks on energy but when he was given the opportunity he failed to justify his talks.
Let’s not also forget that the name if the game is evidence.
So relax comrades, because we have cases pending from 1993 and I believe we shall start from the very beginning till today.
At the end of the show we shall see the difference between Jack and the Killer.
The SP has specific duties to perform and per our constitution he can’t go beyond what has been a located to him.
Below are the functions:
Functions of the Office of the SP
3. (1) To achieve the object, the Office shall
(a) investigate and prosecute cases of alleged corruption and corruption
related offences under the Public Procurement Act, 2003 (Act 663);
(b) investigate allegations of corruption and corruption related offences
under the Criminal Offences Act, 1960 (Act 29) implicating public
officers, politically exposed persons and persons in the private sector
implicated in the commission of the offence;
(c) prosecute corruption and corruption related offences involving public
officers, politically exposed persons and persons in the private
sector implicated in the commission of the offence;
(d) recover the proceeds of corruption;
(e) disseminate information gathered in the course of investigation to
competent authorities and other persons the Office considers
appropriate in connection with the offences specified in paragraphs (a)
and (b);
(f) co-operate and coordinate with competent authorities and other
relevant local and international agencies in furtherance of this Act;
(g) receive complaints from a person on a matter that involves or may
involve corruption and corruption related offences; and
(h) perform any other functions connected with the object of the Office.
So with the above all I can say is for us to continue to concentrate on our reorganisation to strengthen our base to work towards achieving our ultimate goal in 2020.
2020 is possible but it just a matter of time.
Special Prosecutor or no Special Prosecutor we are coming back in 2020.
