The primaries was postponed from 21st November 2015 after a disqualified aspirant, Jim Yao Morti sued the party and the incumbent Member of Parliament, Fifi Kwetey claiming he was unfairly treated.

The Accra High Court on Monday, 21st December, 2015 dismissed the application for injunction brought before it by Jim Yao Morti, paving way for the parliamentary primary in the Ketu South Constituency.

The Court presided over by Daniel Mensah dismissed the application on the basis that the disqualification does not breach Mr. Morti’s fundamental human rights.

The writ filed by Jim Yao Morti stated that, he has fulfilled all the necessary conditions in the NDC’s guidelines for the election, thus could not understand why he was disqualified.

According to Mr. Morti, at his vetting, an issue about him selling a rented car in Togo was raised during which he “provided satisfactory answers to that effect and even provided the necessary documentation to alleviate the issues raised.”

According to him, his vetting was referred to the NDC’s National Executive Committee (NEC) for redress but resorted to the court because “the NEC has not till date, come out with a decision of his candidature and also not communicated same to him or the general public,” yet has not been cleared for the primaries.

The Minister for Food and Agriculture, Fiifi Kwetey would be contesting two others in this primaries.
