The research exposé of Dr. Raymond Atuguba is in the right direction and highly needed.
Our Supreme Court and the entire judiciary has been left alone all this while without any serious criticism so they’ve been unsettled by this [ads1]revelation.
And this is exactly what we need to keep everyone in check in our current democratic dispensation.
For a very long time, almost all legal journals, which used to be the avenue to criticize decisions from our courts have become extinct.
As a result, our judiciary has enjoyed a very long period of silence from any possible criticism of their decision creating the aura or “untouchable”.
Untouchable cannot assist our democratic dispensation in any way. It would rather be a serious impediment to our legal advancement especially from the Supreme Court which holds the key and the mantle of change.
Lack of criticism will make them sleep and we may even get to the point where the judges may import their personal opinions into the law if we have not gotten there yet.
Legal advocacy has dwindled in part due to this untouchable demeanor of so many judges who do not want to learn from experienced lawyers who appear before them but would rather prefer apologies and be begging instead of legal exposition.
It’s about time all the various legal training institutions we have in the country revived and introduced legal journals for more publications of legal articles which not only focus on analyzing decisions of our superior courts but also provide the avenue for the publication of research data such as provided by Dr. Atuguba.
It will make a lot of our judges sit up and generally improve justice dispensation in the country.
In a democracy, the judiciary checks both the Executive and Parliament. One of the major checks on the judiciary is research like this and media publications.
Every institution in our democracy must grow and the judiciary must not be left behind.
