A public-spirited lawyer, Professor Stephen Kwaku Asare, known as Kwaku Azar has emphasized that law is just common sense.
Reacting to social media users who say and think the law is otherwise, he said “I stand with Saint Aquinas who defines law as nothing else than an ordinance of reason for the common good, made by him who has care of the community, and promulgated.”
Prof. Azar explained this in a social media post saying “all the good Saint was saying is that laws are, for the most part, reasonable orders made by accountable lawmakers for the good of the community “.
He maintained that “It is in that sense that the law is just common sense even though these days on FB some say the law is otherwise — it is common folly!”
The lawyer then took a swipe at political parties for their interference and shadow influence on Ghanaian institutions noting “our problem is not that our laws do not reflect common sense. They very much do or else we will all be on the streets demonstrating against them. Our problem is that we do not enforce our laws and where we do only selectively with a partisan bias. Partisanship has reduced our common-sense laws to suggestions”.
He concluded his opinion about the law by citing SALL as an example of how we have reduced our laws to mere suggestions. He stressed, “the common-sense law is that all citizens are entitled to representation in Parliament. But we have #SALL, a clear example of how we reduce our laws to mere suggestions”.
