Kweku Baako drags Nana Addo to court for sacking Charlotte Osei

Veteran journalist Kweku Baako is heading to the Supreme Court to seek clarity on the processes used to remove the Electoral Commission Chair, Charlotte Osei, and her two deputies.

The EC officials were removed after some staff triggered Article 146 by sending a petition to the President who forwarded it to the Chief Justice, Sophia Akuffo.

The suit was filed on his behalf by Lawyer Sampson Lardy Anyenini.

He said the Committee exceeded its scope when it recommended the removal of Charlotte Osei and her two deputies on grounds of misbehaviour and incompetence.

Kweku Baako is also seeking a declaration that the finding by the Chief Justice (CJ) that a prima facie case had been made out in respect of six allegations contained in the petition for the removal of Osei pursuant to Article 146 of the Constitution and which allegations were not founded on acts of stated misbehaviour or incompetence against her in the performance of her core functions as Chairperson of the EC was unconstitutional, null, void and of no effect.

He also wants the Supreme Court to declare that the recommendations for the removal of Osei upon which the President acted were inconsistent with Articles 43 (1)(a), 44 (2), 45 and 146 (1) of the 1992 Constitution and for that matter, null, void and of no effect.

The committee found Charlotte Osei, of blatantly breaching procurement laws in the award of several contracts in her three-year period at the helm of affairs, prior to the 2016 elections.

The Chief Justice determined that there was prima facie evidence worth investigating and set up a five-member committee which recommended the removal of the embattled officials overstated misbehaviour and incompetence.

Since the brouhaha started in July 2017, Kweku Baako has maintained the petition is “really incompetent” adding that the Chief Justice is not expected to form the Committee.

Earlier, he said the decision to oust Charlotte Osei is too hard adding it was a conspiracy.
