Dr. Kwaku Ansah Asah, a former Director of the Ghana School of Law, has weighed in on the controversy surrounding the petitions for the removal of Chief Justice Gertrude Araba Sackey Torkornoo.

He believes that the controversy stems from the actions of former President Nana Addo Dankwa Akufo-Addo, who made a decision on the Chief Justice’s petition before leaving office.

Speaking on Morning Starr, he expressed his preference that the former president should have left the decision to the incoming administration in December of the previous year.

However, he also acknowledged that if Akufo-Addo’s actions were within constitutional boundaries, the decision would remain binding, meaning the current administration cannot intervene.

Dr. Asah further emphasized that if the decision was not in line with constitutional procedures, President John Mahama has the authority to revisit the issue.

He noted that the timing of the former president’s decision was problematic and warned that it would lead to further complications, which, according to him, is now evident in the ongoing dispute.

The situation highlights a complex legal and political debate over constitutional authority and the transition of power in Ghana.
