Court bars Peter Amewu from acting as former Hohoe MP

The Court of Appeal in Koforidua has issued an interlocutory injunction restraining John Peter Amewu from presenting himself as the former Member of Parliament for Hohoe.

This decision follows a legal application filed by Professor Margaret Kweku and others from the Santrokofi, Akpafu, Lolobi, and Likpe (SALL) traditional areas. The court also barred the Speaker of Parliament from processing or disbursing any entitlements to Mr. Amewu until the final determination of the appeal.

Previously, the Ho High Court, presided over by Justice Owoahene Acheampong, dismissed an election petition against Mr. Amewu on July 29, 2024, citing a lack of jurisdiction. However, the petitioners filed a notice of appeal on July 31, 2024, and subsequently applied for an injunction on December 23, 2024.

During the appeal hearing, lead counsel for the petitioners, Mr. Tsatsu Tsikata, argued that Mr. Amewu should not be recognized as a former MP while the legal challenge remains unresolved. He emphasized that allowing him to act in that capacity would be unjust.

In contrast, Mr. Amewu’s legal team maintained that he had not acted improperly. They contended that if there was any error, it was the Electoral Commission’s failure to properly manage the electoral process.

After reviewing the arguments, the three-member panel, chaired by Justice Bright Mensah and supported by Justices Noble Nkrumah and Hafisata Amaleboba, agreed with the petitioners and granted the injunction.
