Former Deputy Attorney General, Alfred Tuah Yeboah, has strongly criticised the Council of State for its role in the suspension of Chief Justice Gertrude Araba Esaaba Sackey Torkornoo.

He believes the Council’s advice to the President was harmful and could damage the independence of the judiciary and Ghana’s democratic system.

In an interview with Channel One TV, Tuah Yeboah said the Council’s recommendation was “very acidic, very poisonous” and warned that such decisions must be taken with care.

His comments follow President John Dramani Mahama’s decision on April 22 to suspend the Chief Justice. This action was taken after three petitions were submitted and a prima facie case was established. In line with Article 146(6) of the Constitution, the President consulted the Council of State before taking the step.

A five-member committee has now been formed to investigate the allegations against the Chief Justice.

Tuah Yeboah believes the Council should have acted more carefully. He said that suspending the head of the judiciary is serious and can affect the confidence people have in the legal system.

He also explained that although the Constitution requires the Council to advise the President, their advice is not final. The final decision rests with the President, but the Council’s input still plays a big role.

He said the Council’s actions could have serious consequences for Ghana’s democracy and warned that future governments may follow the same path if care is not taken.

His remarks have added to the growing debate, as many legal experts, politicians and civil society groups continue to question the suspension and what it means for justice and fairness in the country.

The nation now waits to see what the investigation will reveal.
