Police petitioned to arrest Agyei Addo over alleged forgery and perjury

Mr. Maxwell Agyei Addo has been cited in an alleged case of forgery of documents filed at a High Court in the matters of Maxwell Agyei-Addo vrs. Marivile Homes Ltd.

In an official complaint filed at the Manet Police Station in Accra, sighted by Awake News, the Managing Director of Marivile Homes Ltd, Maria O’Sullivan is asking the Police to arrest Mr. Agyei-Addo for perjury and forgery.

According to her, “On the 17th of February, 2016, the said Maxwell Agyei Addo instituted an action against Mariville Homes Limited at the Hough Court, Land Division, Accra” for which he “on the 1st December 2016, filed a Witness Statement in which he exhibited a site plan (exhibit B) and swore under oath at paragraph 11 that the said site plan [which jointly bears the name of Mr. Maxwell Agyei Addo and Mrs. Gifty Agyei-Addo] was given to him by Mariville Homes Limited.”

She stated that “However, the Court in its judgement delivered on the 13th of February 2017, found as a matter of fact, that the said site plan exhibited by Maxwell Agyei Addo in his witness statement was prepared by himself in the contemplation of litigation, contrary to his sworn testimony that the said site plan was prepared and given to him by Mariville Homes Ltd”

Maria emphasized that on page 4 of the above-said judgement, the Court found that “Although the defendant (Mariville Homes Ltd) did not contest the suit it was evident from an examination of the exhibit B (the site plan) that it could not have been prepared by the Defendant as the Plaintiff (Maxwell Agyei Addo) asserted in his witness statement.”

The court added that “This is because the plaintiff claimed that the defendant repossessed the land in dispute in 2010. It can be deduced from the evidence adduced by the plaintiff that exhibit B was prepared four years after the defendant had repossessed the land in dispute”

The Court further found that “….it was highly improbable that the defendant would give exhibit B to the plaintiff after it has repossessed the land in dispute. It is more probable that the exhibit was prepared by the plaintiff in contemplation of litigation”

For Maria, “The finding of the fact clearly shows that the said Maxwell Agyei-Addo perjured himself when he swore under oath that paragraph 11 of his witness statement that Mariville Homes Limited hand given him a site plan of the land in dispute when he knew that the said site plan was not given to him by Marivile Homes Ltd.”

She also argued that “The above-mentioned finding of fact also shows that the said Maxwell Agyei Addo, with the intent to defraud, forged the said site plan in order to deceive the Court into giving him a favourable judgement.”

The action of Mr. Agyei Addo, the Dubai-based businesswoman believed constitutes perjury and forgery hence wants the Ghana Police Service “investigate the said Maxwell Agyei Addo and possibly institute criminal action against him for perjury contrary to section 211 of the Criminal Offences Act 1960 (Act 29) and forgery contrary to section 159 of the criminal action against him for perjury contrary to section 211 of the Criminal Offences Act 1960 (Act 29)”

Mr. Maxwell Agyei Addo in an interview with Awake News confirmed to have filed the said site plan insisting that the land is for him and the court has given judgement in his favour for which the Defendant has appealed.

Interview with Maria O’Sullivan:

Maria O’Sullivan who is currently in Dubai, told Awake News’ Efo Korsi Senyo that “When I sold the land to them, they didn’t take the document because Gifty the wife said they didn’t like some of the rules and covenants in the lease agreement. She said she is a lawyer and that she will prepare her own lease agreement for me to sign but I said no.”

“They both had made wooden structures on the said land and it was occupied by a couple and family who were selling banku and Akpeteshei in the gated community.  Every effort for them to remove them failed. I then went and reported to the Assembly and they came and demolish the wooden structure. In 2010 Mariville repossessed the said land.  Mr Maxwell Addo was invited to come for their purchase money but he refused”

“Mrs Gifty Agyei Addo and her Husband Maxwell live in the Mariville gated Community but refused to pay security fees. When confronted she said had placed an injunction on the Company in the year 2007 not to collect any monies from Home Owners. Even though the injunction had been thrown out of Court she still insists that it’s still holding.”
