An Assembly Member of the Keta Municipal Assembly for Dziehe-Ablame Electoral Area in the Keta Municipality, Mr. Gilbert Korbla Keklie has stated President Nana Akufo-Addo has breached his presidential oath in relation to the appointments of the members of the council of state.
He noted in a press release issued on February 2, 2021 “that on February 1, 2021, the Acting Communications Director at the Jubilee House, the Office of the President of the Republic of Ghana issued a statement that in accordance with Articles 89(2)(A) and 89(2)(D) of the 1992 constitution of the Republic of Ghana, the President of Ghana had appointed some fourteen members to be members of the yet to be constituted Council of State. And that it was subsequently revealed the President of the Republic has disrespected the Parliament of Ghana by failing to comply with Article 89(2)(A) of the 1992 constitution of the Republic of Ghana. This provision says the Parliament of Ghana should be consulted by the President before making such appointments to the Council of State”.
He stressed that based on this the “President of the Republic has breached his own Presidential Oath because he has pledged to be faithful and true to the Republic of Ghana and that he will at all times preserve, protect and defend the constitution of the Republic of Ghana as per the Second Schedule of the 1992 constitution of the Republic of Ghana”.
Mr. Gilbert Korbla Keklie accordingly advised the president to withdraw the names of the three members he appointed into the Council of State as per Article 89(2)(A) of the 1992 constitution of the Republic of Ghana and properly consult Parliament before going ahead to do same.
However he concluded that if President Akufo Addo fails “to consult Parliament as per Article 89(2)(A) of the 1992 constitution of the Republic of Ghana before the Council of State is duly constituted, I will invoke the Jurisdiction of the Supreme Court of Ghana as per Articles 2(1)(a)(b) and 19(23) of the 1992 constitution of the Republic of Ghana”.

THE PRESIDENT OF THE REPUBLIC OF GHANA HAS DISRESPECTED PARLIAMENT OF GHANA IN VIOLATING ARTICLE 89(2)(A) OF THE 1992 CONSTITUTION.
1. That on February 1, 2021, the Acting Communications Director at the Jubilee House, the Office of the President of the Republic of Ghana issued a statement that in accordance with Articles 89(2)(A) and 89(2)(D) of the 1992 constitution of the Republic of Ghana, the President of Ghana had appointed some fourteen members to be members of the yet to be constituted Council of State.
2. That based on the Proceedings of Parliament of Ghana on February 2, 2021, it was revealed that the President of the Republic has disrespected Parliament of Ghana by failing to comply with Article 89(2)(A) of the 1992 constitution of the Republic of Ghana. This provision says the Parliament of Ghana should be consulted by the President before making such appointments to the Council of State.
3. That based on paragraph 2 in this release, the President of the Republic has breached his own Presidential Oath because he has pledged to be faithful and true to the Republic of Ghana and that he will at all times preserve, protect and defend the constitution of the Republic of Ghana as per the Second Schedule of the 1992 constitution of the Republic of Ghana.
4. That the President of the Republic is accordingly advised to withdraw names of the three members he appointed into the Council of State as per Article 89(2)(A) of the 1992 constitution of Republic of Ghana and properly consult Parliament before going ahead to do same.
5. That should the President of the Republic fail to consult Parliament as per Article 89(2)(A) of the 1992 constitution of the Republic of Ghana before the Council of State is duly constituted, I will invoke the Jurisdiction of the Supreme Court of Ghana as per Articles 2(1)(a)(b) and 19(23) of the 1992 constitution of the Republic of Ghana.
