Two top management staff of Mantrac Ghana Ltd have been accused of disobeying court orders hence are being cited for contempt of court in a writ sighted by Awake News.
The Managing Director, Mr. Andy Sassou and Mr. Raymond Kelson, the Human Resource Operations Manager have been dragged to court by their former employee, Mr. Stephen Quansah and want two charged for contempt of court.
In an affidavit in support of the committal for contempt application, Mr. Stephen Quansah said he “was until the 24th of August 2016 an Employee of Mantrac Ghana Limited as the fuel and Lube Operator.” and “caused a Writ of Summons and Statement of Claim dated 2nd February, 2018 to be issued against Mantrac Ghana Limited in Suit with number E/7/2018 at the High Court, Sekondi.” making claims for release of his entitlements from my Provident Fund for which the court on March 16, 2020 granted his application for “immediate access” to the entitlements.
According to Mr. Quansah, following the Court’s ruling, “on the 16th and the 18th of March, 2020 I caused my lawyer to write a letter to Mantrac Ghana Limited informing it of the Court Order and my availability to undergo all Administrative processes needed to be carried out in order to receive my provident fund entitlement.” adding that “on the 19th of March, 2020, I was accompanied by one of my lawyers to Mantrac Ghana Limited to undertake all the administrative processes required.”
Further, “on the 20th of March, 2020, I caused to be written a letter to Axis Pension Trust, the Administrators of my provident fund, to inform it of the Court Order, my completion of all the administrative process at Mantrac, and requesting for the release of my Provident Fund.” and “on the 16th of January, 2020, I caused to be filed a Motion for an Order Directing Mantrac Ghana Limited to pay my provident fund benefits.” for which “on the 18th of February, 2020, I further caused to be filed a supplementary Affidavit in Support of Motion on Notice for an Order directing Mantrac Ghana Limited to pay my provident fund entitlement.”
He said that “Mantrac Ghana Limited filed an Affidavit in Opposition to my Motion for an Order to pay my Provident Fund on the 20th of January, 2020.”
Mr. Quansah told the Court that after going through all the processes and spending a “whole day at the offices of Mantrac Ghana Limited on the 21st of April 2020,” the the “Respondents failed to instruct” my their bankers to pay him.
This he said “the Respondents have directly defied the orders of this Honourable Court to pay my provident Fund benefits.” and through his lawyer, Nii Kpakpo Somoa Addo “In the circumstance, I pray that this obvious disregard to the Court amounts to nothing more than contempt of which the Respondents ought to be convicted.”
