Breaking News: Korsi Senyo petitions CID, EOCO over GH¢4.5m Registrar General scandal

Investigative Journalist, Korsi Senyo has petitioned the Criminal Investigation Department of Ghana Police Service and Economic and Organized Crime Office (EOCO) with findings of his investigations at the Registrar General Department where he claims to have uncovered a GHc4.5m scandal in the liquidation of Toku Company Ltd in 2011.

In the five-page petition, Korsi Senyo has cited new evidence which he alleged that the Registrar General might have not been able “to account for about One Million Six Hundred Thousand Ghana cedis (GH¢1.6m)”

He is, therefore, asking the Police CID and EOCO to investigate and prosecute some 25 people in connection with the liquidation of the company and sales of a landed property located on the Graphic Road to Letap Pharmaceutical Ltd at the cost GHc4.5 million.

The list of individuals he wants to be investigated and subsequently prosecuted include the former Registrar General, Mr. JK. Halley; Company Inspector, Mr. Jonas Ansah; Susan Awuku, Director of Toku Company Ltd; Mr. H.R. Patel, Managing Director of Letap Pharmaceuticals Ltd; Mr. Leo Kweku Asiamah; Mr. Alex Kojo Asiamah and 19 others.

Background:

If readers can recall, the investigative journalist on December 6 last year released an investigative piece titled “BOMBSHELL: GH¢4.5M SCANDAL HITS REGISTRAR GENERAL” where he alleged that some officials at the Registrar General Department had colluded with some individuals to wrongfully liquidate Toku Company Ltd and sell a landed property of another company, Swedru Contractors in 2011.

The current Registrar General, Mrs. Jemima Oware in her response to some 17 questions posed to her by Korsi Senyo declined to provide the answers to his questions saying:

Indeed if you require any information on the Toku Company Ltd prior to the liquidation of the company, you have to conduct a general search under section 333 of the Companies Act, 1963 (Act 179) at the Registry of the Department and the requisite answers you require will be provided you accordingly

Consequently, if you are of the strong opinion that we have breached any provision/s of the Bodies Corporate (Official Liquidations) Act 1963 (Act 180) you are at liberty to proceed to Court under Section 11 of Act 180, stating your capacity and the kind of breach the Official Liquidator has committed

To this end, therefore, we are unable to accede to your request for the Court is the primary forum to address your concerns if you are minded that you are aggrieved by any breach of Act 180.

Korsi Senyo after the release of the exposé appeared on a number of radio programs to give further clearance to the issues contained in the his report, including an interview with Captain Smart on Adom FM’s morning show where the investigative journalist clashed with the Registrar General’s legal adviser, Mr. George Kofi Bekai and her Consultant, Mr. Ahlidza.

Registrar General petitions National Media Commission:

The Registrar General’s Department under the Ministry of Justice and Attorney Generals Department has petitioned the National Media Commission (NMC) citing misconduct and unprofessionalism at the part of investigative journalist Efo Korsi Senyo, on the publication of matters relating to his exposé on the liquidation of Toku Company Limited.

The petition dated December, 20th 2018, to the National Media Commission (NMC), by the Registrar-General and the Official Liquidator of Toku Company Ltd, Mrs. Jemima Maama Oware described the journalist’s actions as a move to scandalize and impugn the integrity of the official liquidator and the office of the Registrar General.

The petition went further to state that there was no wrongdoing in the liquidation of Toku Company Limited as being purported by the journalist in his report.

Mrs. Oware, the Registrar General, by the petition is asking the National Media Commission to;

i. restrain the investigative journalist, Efo Korsi Senyo from any act, conduct to impugn the integrity of the official liquidator, Toku Company Limited.

ii. restrain Efo Korsi Senyo from publishing on the website or on his facebook page, on the subject matter.

iii. apologize and withdraw the publication against the official liquidator, Toku Company Limited from Awake Newspaper and all other platforms.

iv. lastly, issue a perpetual restrain order to the journalist not to publish, comment or speak in any public forum on the subject matter.

But, the petition has not deterred the rather appeared fearless Korsi Senyo and in his response to the petition to the National Media Commission told the Registrar General that he can never be intimidated by her petition.

He has also stated that, “I wish to remind the Registrar General and the Official Liquidator that she cannot run away from her past activities as far as the liquidation of the Toku Company is concerned.”
