The Member of Parliament for the Madina Constituency in the Greater Accra Region, Francis-Xavier Sosu Has filed human rights actions against the Inspector General of Police, Dr. George Akufo Dampare
The lawmaker who is also a renowned and award-winning Human Rights Lawyer led his constituents in a #FixOurRoads Demonstration as part of his parliamentary duties filed the Human Rights action pursuant to Article 33 of the 1992 Constitution of Ghana and Order 67 of the High Court (Civil Procedure) Rules, C.I 4 for the enforcement of His Fundamental Human Rights.
The applicant (Hon. Sosu) is asking for an order for the enforcement of his right to freedom of movement, right to protest and demonstrate, right to personal liberty, right to freedom of expression, and right against unlawful arrest and malicious prosecution (Articles 14(1), 21(1) and 33 of the 1992 Constitution) of the Applicant and for an Order for Stay of all Criminal Investigations and proceedings by the Ghana Police Service and the Inspector General of Police.
The Human Rights action is also accompanied by an injunction application to restrain any further attempt at unlawful arrest of the MP until the full determination of the Human Rights action.
The action which was filed on Tuesday, November 16, 2021 will be heard on Monday, December 13, 2021.
The MP whiles addressing demonstrators at Ayimensah had to escape following the Police attempt to arrest him. He then petitioned the Speaker of Parliament against the police for which the Speaker has constituted a committee to investigate if the action of the police amounts to contempt of Parliament.
Even before the Committee began its works the police stormed the church of Mr. Sosu to arrest him for which he escape again. His police guard was then interdicted for allegedly aiding the MP to escape arrest.
Declaring the MP as a suspect over his alleged involvement in blocking roads and destroying public property which the MP has since denied, the Police said they are resumed to arrest and prosecute the MP together with all his alleged accomplices.
