Congratulations to the Amnesty International and Occupy Ghana for voicing out against the purposeless regime orchestrated to infringe the rights of suspect Gregory Afoko.
Subsequent to the arrest of Gregory Afoko as a suspect in the murder of the late Upper East regional chairman of the ruling NPP, an Accra high court of competent jurisdiction granted him (Gregory Afoko) bail in March, 2019.
Gregory Afoko satisfied all the bail conditions under the supervision of this same high court. For whatever reason known to only the Ghana Police Service, they refused to release the suspect requesting to do their independent investigation about the satisfaction of the bail conditions. The question here is, what powers do
the police have to investigate what a high court has investigated and made a determination on same?
The State Attorney proceeded to an Appeal Court to quash the decision of the High Court in granting the suspect bail. This matter is yet to be determined by the Appeal Court. The defence team in this matter has also filed a habeas corpus which is also yet to be determined.
What is more intriguing that, even though the Appeal Court has not determined the matter brought before it by the State Attorney, the State Attorney proceeded to file fresh charge sheets before another High Court to rescind the decision of the first High Court. Does a High Court have the powers to rescind the decision of another High Court?
There’s a determined effort by the Attorney General department and for that matter government to frustrate Mr. Gregory Afoko. The actions of government undermines the provisions of the 1992 constitution of the Republic that guarantees the innocence and rights of individuals until they are proven guilty by a competent court of jurisdiction.
Why was Gregory Afoko still in custody despite an explicit court order?
I will humbly call on the Peace Council, the Christian Council, the Ghana BAR Association and all meaning Ghanaian groupings and individuals to speak against this novel regime engineered to undermine the rule of law.
May God bless our homeland Ghana and help us resist oppressor’s rule.
