Assin North: Court grants injunction against NDC MP-elect

The Cape Coast High Court has granted an injunction preventing the Member of Parliament-elect for the Assin North constituency,James Gyakye Quayson from being sworn-in into the 8th Parliament on Thursday, January 7, 2021.

The petition was filed by one Michael Ankoma-Nimfah who is a Mason and resident of Assin Bereku in the constituency on grounds of dual citizenship when he was filing to contest which is against the constitution.

The presiding High Court Judge, Justice Kwadwo Boakye Tawiah stressed that the issues raised against Mr. Quayson are grievous and would need a full trial, he passed the ruling with other consequential orders including an order to Mr. Quayson to desist from holding himself as an MP-elect for the Assin North.

According to the petitioner, Mr. Quayson owes allegiance to both Ghana and Canada which contravenes the provision of Article 94 (2) (a) of the 1992 Constitution of Ghana.

Earlier, the NPP through its lawyers wrote to the Ghana Immigration Service seeking information on his Canadian citizenship status as at the time he filed to contest the elections.

A letter circulated on social media, showed Mr. Quayson denounced his Canadian citizenship before being elected as MP for Assin North including a travelling certificate which also proves that he had surrendered his Canadian citizenship prior to him filing as a Parliamentary candidate of the NDC for the 2020 elections.

However, how the court came to this conclusion will only be finalised in the subsequent proceedings.

James Gyakye Quayson won the Assin North seat with 17,493 votes as against the incumbent NPP MP who polled 14, 193 of the valid votes cast.
